This Loan Agreement and Credit Terms ("Agreement") governs the digital credit services made available through the KKPesa mobile application ("App") in Kenya. Please read this Agreement carefully before you apply for or confirm any loan.
Each specific loan offer shown to you in the App forms part of this Agreement. Before you tap "Confirm & Apply", the App will display your approved loan amount, interest, fees, repayment amount, repayment due date, and other applicable charges.

Loan Amount: The approved loan amount will be displayed in the App before you confirm the loan.
Repayment Term: 91 to 365 days
Annual Percentage Rate (APR): The equivalent maximum APR, including applicable interest and charges, will not exceed [36%]. The exact APR applicable to your approved loan will be shown in the App before you confirm the loan.
Charges: Applicable charges may include interest, service fees, processing fees, late payment charges, and any other charges expressly disclosed to you before loan confirmation. All such charges, if any, will be shown in the App before you accept the loan.
Due Date and Total Cost of Credit: Your repayment due date and total cost of credit, including principal, interest, fees, charges, and other liabilities, will be displayed on the Loan Details screen before you confirm the loan.
Complaints: If you have any complaint or dispute about your loan, you may contact us through the complaint channels listed in this Agreement and in the App.

To use the lending services available through the App, you must:
Submission of an application does not guarantee loan approval.
3.1 You may apply for a loan through the App by completing the required identity verification, profile submission, and any other information or consent flow required by us or by law.
3.2 We may conduct identity verification, fraud screening, affordability review, internal risk assessment, and credit checks as permitted by law.
3.3 We may approve, decline, or limit any application at our discretion, subject to applicable law and our internal risk policies.
3.4 If your application is approved, the App will present the Loan Details before you confirm the loan.
4.1 The Loan Details shown in the App before confirmation form an integral part of this Agreement.
4.2 The Loan Details will include, at a minimum, the following information:
4.3 You accept the loan only when you tap the confirmation button in the App, such as "Confirm & Apply", after reviewing the Loan Details and this Agreement.
4.4 If you do not agree with the Loan Details or this Agreement, do not confirm the loan.
5.1 Once your loan is approved and confirmed, we will disburse the approved funds to your registered mobile money wallet, verified bank account, or other approved payment destination shown in the App.
5.2 Disbursement times may vary depending on payment channel availability, verification status, system processing, or third-party service interruptions.
5.3 We are not responsible for delays caused solely by telecom operators, banks, payment providers, or circumstances beyond our reasonable control.
6.1 Interest and any applicable fees or charges will be disclosed to you in the App before loan confirmation.
6.2 Charges may include, where applicable:
6.3 We will not impose undisclosed charges on your loan.
6.4 The total cost of credit will be displayed to you before you accept the loan.
6.5 If any general terms are changed, we will provide prior notice where required by applicable law.
7.1 You must repay the loan in full on or before the repayment due date shown in the App and in your loan records.
7.2 Repayment may be made through the repayment channels made available in the App from time to time.
7.3 You are responsible for ensuring that sufficient funds are available and that repayment is made on time.
7.4 Any payment received may be applied in the following order, unless otherwise required by law:
8.1 A loan becomes overdue if payment is not received by the due date.
8.2 If you fail to repay on time, we may apply disclosed late payment charges or other lawful remedies as disclosed before loan confirmation and as permitted by applicable law.
8.3 We may use lawful and fair debt recovery procedures.
8.4 We will not use threats, harassment, public shaming, obscene language, or unlawful debt collection practices.
8.5 Our recovery rights are subject to Kenyan law, including any legal limits on recoverable amounts in relation to non-performing loans.
9.1 You authorize us, where permitted by law, to obtain and share your credit information with licensed credit reference bureaus and other lawful data sources for credit assessment, account management, fraud prevention, and compliance purposes.
9.2 We may report positive and negative credit information as permitted by Kenyan law.
9.3 Before submitting negative credit information to a credit reference bureau, we will provide any prior notice required by applicable law.
9.4 We will use reasonable efforts to ensure that credit information we submit is accurate, complete, and timely.

11.2 Please include your full name, registered phone number, loan reference number, and a brief description of your complaint.
11.3 We will acknowledge your complaint within [2] business days and aim to resolve it within [14] business days, unless more time is reasonably required.
11.4 If you remain dissatisfied, you may escalate the complaint through any regulatory or legal channels available under Kenyan law.
12.1 We collect, use, store, and process personal data in accordance with our Privacy Policy and applicable Kenyan law, including the Data Protection Act, 2019.
12.2 We use your information for identity verification, credit assessment, fraud prevention, customer support, legal compliance, account administration, and service improvement.
12.3 You are responsible for keeping your device, PIN, password, OTPs, and account credentials secure.
12.4 Notify us immediately if you suspect unauthorized access to your account.
13.1 We may suspend, restrict, or terminate access to the App or our services if:
13.2 Termination of app access does not extinguish any outstanding repayment obligations.
14.1 We may update this Agreement from time to time to reflect legal, regulatory, operational, or product changes.
14.2 Where required by law, we will provide prior notice before changes take effect.
14.3 The latest version of this Agreement will be made available in the App and on our website.
15.1 This Agreement is governed by the laws of Kenya.
15.2 We encourage customers to first use our internal complaint handling process.
15.3 If a dispute is not resolved through our internal process, either party may refer the matter to a competent court, tribunal, regulator, or other lawful dispute resolution forum in Kenya.
